Welcome to Enjoyment Radio. These Terms of Service ("Terms") govern your access to and use of the Enjoyment Radio mobile application, the Fan Love Africa service available at fanloveafrica.com, and any related websites, content, features, and services (collectively, the "Services") operated by Enjoyment Radio ("we," "us," or "our"), a business registered and operating in Accra, Republic of Ghana.
By creating an account, downloading the app, or otherwise using any of the Services, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you must not use the Services.
Enjoyment Radio provides:
You must be at least thirteen (13) years old to use the Services. If you are under the age of majority in Ghana (eighteen, 18), you represent that you have obtained permission from a parent or legal guardian to use the Services and that they have agreed to these Terms on your behalf.
You may not use the Services if you are barred from doing so under the laws of Ghana or any other jurisdiction that applies to you.
To access certain features, you must create an account. You agree to:
We reserve the right to suspend or terminate accounts that violate these Terms, that contain false information, or that are used to abuse the Services or other users.
You may submit content to the Services, including but not limited to Fan Love request text, custom song briefs, voice notes, and feedback ("User Content"). You retain ownership of your User Content.
By submitting User Content, you grant Enjoyment Radio a worldwide, non-exclusive, royalty-free, sublicensable licence to use, host, store, reproduce, modify (for formatting and delivery), and display your User Content solely for the purpose of operating, providing, and improving the Services, and for delivering your request to the relevant Celebrity Partner.
You represent and warrant that:
6.1 Placing a Request. Users may purchase personalised content (video messages, custom songs, shout-outs, and similar) from Celebrity Partners through Fan Love Africa. Prices are displayed in Ghana Cedis (GHS) on each Celebrity Partner's profile.
6.2 Payments. Payments are processed by Paystack, an independent third-party payment processor. By making a purchase, you also agree to Paystack's terms of service. Enjoyment Radio does not store your full card number or CVV; card data is handled by Paystack under their PCI-DSS compliant infrastructure.
6.3 Delivery. Each Celebrity Partner sets their own turnaround time, shown on their profile. We use reasonable efforts to deliver requests within this window but do not guarantee exact delivery timing.
6.4 Refunds. You are entitled to a full refund if:
Refunds are not available once a request has been delivered and approved, or where the content was refused on grounds set out in §6.5. Refund requests should be sent to info@enjoymentradio.live. Approved refunds will be returned to the original payment method via Paystack, typically within 5–10 business days.
6.5 Right to Decline. Celebrity Partners and Enjoyment Radio reserve the right to decline any request that is unlawful, offensive, defamatory, harassing, sexually explicit, promotes hatred or violence, infringes third-party rights, or violates these Terms. Declined requests are refunded in full.
Celebrity Partners participate in Fan Love Africa under a separate agreement with Enjoyment Radio. Celebrity Partners are independent contractors and not employees or agents of Enjoyment Radio. Enjoyment Radio is not responsible for the personal statements, opinions, or conduct of Celebrity Partners outside the Services.
You agree not to:
All content provided by Enjoyment Radio through the Services — including but not limited to audio programming, show artwork, logos, trademarks, graphics, interface design, and software — is the property of Enjoyment Radio or its licensors and is protected by Ghanaian and international copyright, trademark, and other intellectual property laws.
You may access and use this content solely for your personal, non-commercial enjoyment of the Services. Any other use requires our prior written permission.
Celebrity Partner-created Fan Love videos are licensed to the purchasing user for personal, non-commercial use only. Commercial exploitation (advertising, resale, broadcast, etc.) is prohibited without separate written permission from the Celebrity Partner and Enjoyment Radio.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OR ERROR-FREE OPERATION.
Enjoyment Radio does not warrant that the Services will always be available, accurate, complete, or free of viruses or other harmful components.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ENJOYMENT RADIO, ITS OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES.
Our total liability to you for any claim arising from or related to the Services shall not exceed the greater of (a) the amount you paid to Enjoyment Radio in the twelve (12) months preceding the claim, or (b) GHS 500.
Nothing in this section limits or excludes any liability that cannot lawfully be limited or excluded under the laws of Ghana, including liability for death or personal injury caused by our negligence or for fraudulent misrepresentation.
You agree to indemnify and hold harmless Enjoyment Radio and its affiliates from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of your breach of these Terms, your User Content, or your misuse of the Services.
These Terms are governed by the laws of the Republic of Ghana, without regard to conflict-of-law principles. You and Enjoyment Radio agree to submit to the exclusive jurisdiction of the courts of Accra, Ghana for the resolution of any dispute arising out of or relating to these Terms or the Services.
Before commencing any legal action, you agree to contact us at info@enjoymentradio.live and attempt to resolve the dispute informally within thirty (30) days.
We may update these Terms from time to time. When we make material changes, we will:
Your continued use of the Services after the updated Terms take effect constitutes your acceptance of the changes. If you do not agree to the changes, you must stop using the Services.
You may close your account at any time by contacting info@enjoymentradio.live. We may suspend or terminate your access to the Services at any time, with or without notice, for conduct that we reasonably believe violates these Terms or is harmful to other users, to us, or to third parties.
Sections that by their nature should survive termination (including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law) shall survive.
